These general conditions of sale (hereinafter only “General Conditions”) govern the sale of the products marketed by CV Cappeller & Volpe SRL, through the website www.emmaalicemartin.com. All contracts for the purchase of products concluded, through the website www.emmaalicemartin.com and according to the procedures indicated therein, between the seller and the customer, will be governed by these General Conditions.

The display of the assortment of products in the online store referred to in the internet address of the previous point does not represent an offer to the public referred to in art. 1336 C.C .. It is subject to change and not binding. CV Cappeller & Volpe SRL reserves the right, at its sole discretion, to accept the order.

The contract with CV Cappeller & Volpe SRL is finalized when the same accepts the customer’s offer by sending the products ordered by the same. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

Once the online purchase procedure has been completed, the Customer will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of Articles 50 and ss. of the Legislative Decree n. 206/2005 on distance selling.

Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.

The Customer can only purchase the products in the electronic catalog and / or in CV Cappeller & Volpe SRL’s ongoing promotions at the time of placing the order and viewable at the address (URL) www.emmaalicemartin.com as described in the relevant information sheets.

Correct receipt of the order is confirmed by CV Cappeller & Volpe SRL through an e-mail reply, sent to the e-mail address supplied by the Customer. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. In the event of non-acceptance of the order, CV Cappeller & Volpe SRL will promptly notify the Customer, in the same manner. All prices on the site are to be intended as prices to the public, inclusive of VAT. CV Cappeller & Volpe SRL reserves the right to change prices at any time, without prior notice.

Until payment is completed, the shipped goods remain the property of CV Cappeller & Volpe SRL.

CV Cappeller & Volpe SRL accepts orders for deliveries in the Italian and international territory.
For every order placed on www.emmaalicemartin.com, CV Cappeller & Volpe SRL issues a transport document (DDT) for the material shipped. For the issue of the DDT, the information provided by the Customer at the time of the order is valid.
The shipping cost for orders in Italy is € 10, € 25 for Venice and all the islands, € 50 for Livigno. For shipments abroad, contact us to request a quote.
Shipments are free in Italy for orders over € 600.
CV Cappeller & Volpe SRL reserves the right to establish the delivery date of the purchased products, based on what is reported in the product sheet.
The same may undergo changes due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority. No responsibility can be attributed to CV Cappeller & Volpe SRL in the event of a delay in order fulfillment or delivery of the ordered goods.
Upon delivery of the goods by the courier, the Customer is required to check: that the packaging is intact, not damaged, nor wet or, in any case, altered, even in the closing materials (adhesive tape or metal straps), which the number of packages delivered corresponds to what is indicated in the delivery note. Any damage or the mismatch in the number of items or information must be immediately reported to the courier making the delivery, adding the wording “withdrawal with reserve” on the appropriate accompanying document and confirmed within two days by email to: info @ teslamall.com. Even if the packaging is intact, the goods must be checked within two days of receipt. Any hidden anomalies must be reported in writing by email or registered A / R. Any report beyond the aforementioned terms will not be taken into consideration. For each declaration, the customer assumes full responsibility for what is declared. Once the courier’s document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.

Pursuant to art. 64 of Legislative Decree 206/2005, the customer has the right to withdraw from the purchase contract within 10 working days from the date of receipt of the goods. The withdrawal must be exercised by sending a written communication by registered letter with return notice (A / R) that expresses the will to withdraw from the concluded contract. This communication must be sent to:

A. If the right of withdrawal is exercised within 48 hours of sending the order and before the shipment of the goods, the refund of the sums paid will take place according to the procedure described in the point “cancellation of payment”. In the event of withdrawal, both parties are required to return the services obtained.
B. If the right of withdrawal is exercised after the shipment of the goods, for the return, this must be intact, not used or damaged and contained in its original packaging. The return must be made no later than 10 working days from the date of receipt of the item with insured package prepaid (the date of the shipping postmark will be valid). The shipping costs for returning the goods remain the responsibility of the customer. If the right of withdrawal is exercised in accordance with these instructions, CV Cappeller & Volpe SRL will reimburse, within a maximum period of 30 days from receipt of the notice of withdrawal, the sum paid for the purchase of the goods.
Pursuant to art. 59, letter c) of the Consumer Code, the right of withdrawal is not allowed for personalized or made-to-measure products.
